COMCO-Decision on Mechanical Watch Movements from Swatch | ETA

With its decision of 15 July 2020, the Swiss Competition Commission (COMCO) concluded its reconsideration proceeding against the Swatch subsidiary ETA SA Manufacture Horlogère Suisse (ETA). The COMCO stands by its decision of 2013 and refrains from regulating new delivery obligations for ETA from 2020 onwards. In the opinion of the COMCO, however, ETA continues to dominate the market for mechanical Swiss made movements. ETA is therefore still subject in particular to the behavioural control of article 7 of the Swiss Cartel Act. Refusals to supply by ETA may still be inadmissible despite the absence of a general supply obligation.
