17 February 2026 – According to a press release, the Competition Commission (COMCO) has significantly expanded the scope of companies involved in the ongoing investigation into possible bid-rigging in the canton of Jura (see our original post). Instead of the six companies initially under investigation, the focus of the enquiries has now shifted to around 20 construction firms.
Bid-rigging is one of the most serious breaches of competition law, as it can eliminate competition and lead to higher prices. In this case, according to COMCO, there is a suspicion that the companies under investigation coordinated their tenders and prices over several years for public and private sector procurement contracts. More than 150 tenders in civil engineering and building construction from the years 2016–2025 are potentially affected.
Companies would be well advised to regularly review their tendering processes and compliance structures – and to seek expert support at an early stage in the event of official investigations.
The presumption of innocence continues to apply to all companies concerned.
